What are the 7 categories of elder abuse under California law?

W&I Code §15610 defines 7 categories: (1) physical abuse, (2) neglect, (3) financial abuse, (4) abandonment, (5) isolation, (6) abduction, and (7) mental suffering/emotional abuse. Your policy must address all seven and require reporting of known or suspected abuse in any category.

Who is a mandated reporter in an RCFE?

Under W&I Code §15630, all staff of an RCFE - including administrators, caregivers, cooks, drivers, and volunteers who regularly interact with residents - are mandated reporters. Failure to report known or suspected abuse is a misdemeanor.

What are the reporting timeframes?

Mandated reporters must make an immediate oral report by telephone to APS or local law enforcement. A written report must follow within 2 working days. If the abuse involves physical injury or imminent danger, emergency services (911) must be called first.

Can I suspend an alleged perpetrator before the investigation concludes?

Yes, and in many cases you should. If the alleged perpetrator is an employee and poses an ongoing risk to residents, CDSS expects the administrator to take protective action, which typically means placing the employee on paid administrative leave pending investigation. This policy includes the required suspension procedure.

What protections exist for staff who report abuse?

California law prohibits retaliation against any person who makes a good faith report of elder abuse. This includes discharge, demotion, or any adverse employment action. Your policy must include this non-retaliation protection and communicate it to all staff.
